Terms of Use

1. Acceptance

By downloading, accessing, or using Defogit, you agree to these Terms of Use. If you do not agree, please do not use the app or website.

2. About Defogit

Defogit is a calm focus and grounding experience for iOS with an interactive simulated fogged-glass surface. You can clear the fog and draw with your finger while thinking, listening, or taking a quiet break. The app and website are provided by Evgeny Knoblokh, an individual based in Thailand, under the Knoblabs brand.

3. License

For copies of Defogit obtained through the App Store, the Apple Standard End User License Agreement governs the app license unless a separate custom license is provided with the app. These Terms supplement the applicable license for Defogit's services and website; they do not replace it or limit rights granted under it.

You may not copy, modify, distribute, reverse engineer, or exploit the app or website except as allowed by the applicable license, third-party licenses, or law.

4. Optional one-time purchases

The main Defogit experience is available free of charge. Defogit may offer premium background collections as optional one-time in-app purchases through the Apple App Store. Each collection is a separate non-consumable purchase. Buying one collection does not provide access to any other collection. Defogit does not offer subscriptions, free trials, or recurring payments.

• Price and payment. Apple displays the price for each collection in your local currency before you confirm the purchase. Different collections may have different prices. Apple processes payment through the Apple Account you use for the App Store and maintains the transaction history. Neither Knoblabs nor the developer receives your payment card or bank details or your Apple Account password.
• Adapty's role. Adapty helps display purchase offers and product information and helps confirm access to purchased collections. Adapty is not your payment provider; Apple processes the purchase and any refund.
• Access. A confirmed non-consumable purchase unlocks the corresponding background collection. Access is intended to remain available without a recurring fee, subject to the continued validity of the transaction, compatibility of the app and device, and continued availability of the app and the purchased content.
• Restore purchases. You can use Restore Purchases in Defogit on a compatible device to restore an eligible collection using the Apple Account associated with the original purchase. Restoration depends on Apple's confirmation of the transaction and the continued compatibility and availability described above.
• Refunds and invalid transactions. Apple handles refund requests under its App Store policies and applicable law. A refund, transaction reversal, or determination that a transaction is invalid may remove access to the related collection.

Apple provides instructions for requesting a refund and restoring eligible purchases.

5. Acceptable use

You agree not to use Defogit or the website in a way that:

• violates any law or regulation;
• interferes with the operation or security of the app, website, or connected services;
• attempts unauthorized access to systems, data, or accounts; or
• uses the app or website in a fraudulent or abusive manner.

6. Intellectual property

Defogit, its design, content, branding, and related materials are protected by intellectual property rights owned by or licensed to Evgeny Knoblokh, operating under the Knoblabs brand, except where specific third-party rights apply.

7. Availability

We may update, change, suspend, or discontinue any part of Defogit or the website. We do not guarantee uninterrupted availability or compatibility with every current or future device or operating system. We will not limit any mandatory rights you have under applicable consumer law.

8. Disclaimer

Defogit is intended as a calm focus and grounding experience. It does not provide medical, psychiatric, psychotherapeutic, therapeutic, legal, or financial services. It does not diagnose, treat, cure, or prevent ADHD, anxiety, or any other condition, does not promise a particular result, and is not a substitute for professional advice, diagnosis, or treatment.

9. Limitation of liability

To the fullest extent permitted by law, Evgeny Knoblokh, operating under the Knoblabs brand, will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business arising from your use of Defogit or the website. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

10. Termination

These Terms remain in effect while you use Defogit. We may suspend or terminate access where reasonably necessary, including for abuse, unlawful activity, fraud, or protection of the service. Any effect on purchased content remains subject to applicable law, the validity of the transaction, compatibility, and continued availability of the app and content.

11. Governing law

These Terms are governed by the laws that apply to the operator and your use of Defogit, without regard to conflict-of-law rules. If the law where you live gives you mandatory consumer rights or requires a particular forum, those rights and requirements are not limited by these Terms.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of Defogit after updated Terms are made available means you accept the revised Terms.
